Welcome to Lumberjack Health. These Terms & Conditions (“Terms”) govern your access to and use of the Lumberjack Health website, services, and platform (collectively, the “Services”).
Please read these Terms carefully before using our Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.
1. IMPORTANT MEDICAL DISCLAIMERS
Not Medical Advice: The content and information on our website are for informational purposes only and do not constitute professional medical advice, diagnosis, or treatment. Our platform facilitates communication with licensed healthcare practitioners, but the platform itself does not provide medical advice.
NO EMERGENCIES: Our Services are NOT for medical emergencies. If you are experiencing a medical emergency, please call 911 or go to your nearest emergency room immediately.
Service Availability: Our Services are available only to individuals located in the Canadian provinces and territories where we operate.
2. Eligibility
To use our Services, you must:
Be at least the age of majority in your province or territory of residence.
Be physically located in a Canadian province or territory where our Services are available.
Agree to provide accurate, current, and complete information about yourself as prompted by our registration and medical intake forms.
3. Description of Services
Lumberjack Health is a digital health platform that facilitates telehealth consultations between patients and independent, licensed Canadian healthcare practitioners (“Practitioners”). Our Services include:
Facilitating online assessments.
Connecting you with a Practitioner for a consultation.
If deemed medically appropriate by the Practitioner, facilitating the fulfillment and delivery of your prescription through our partner pharmacies.
4. User Accounts
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for ensuring that all information you provide is accurate and truthful.
5. Prescription and Pharmacy Services
Practitioner’s Discretion: A consultation does not guarantee that a prescription will be written. The decision to issue a prescription is at the sole discretion of the consulting Practitioner based on their professional medical judgment.
Partner Pharmacies: All prescriptions are filled and dispensed by one of our accredited Canadian partner pharmacies. By using our Services, you consent to your personal and prescription information being shared with our partner pharmacy for the purpose of fulfillment and delivery.
6. Payment, Billing, and Subscriptions
Fees: You agree to pay all fees associated with the Services you purchase. All prices are listed in Canadian Dollars (CAD).
Subscriptions: If you purchase a subscription-based service, you agree to the recurring billing terms. Your subscription will automatically renew at the end of each billing cycle unless you cancel it in accordance with our cancellation policy.
Refunds: Due to the nature of pharmaceutical products, medications purchased through our Services are non-refundable once they have been dispensed by the pharmacy. Consultation fees may be non-refundable as specified at the time of purchase.
7. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Lumberjack Health or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited license to access and use the Services for personal, non-commercial use only.
8. User Conduct
You agree not to use the Services for any unlawful purpose or in any way that could harm, disable, or impair the platform. You agree to provide honest and accurate information during your consultation.
9. Termination
We reserve the right to suspend or terminate your account and access to the Services at our discretion, without notice, for any reason, including for violation of these Terms.
10. Disclaimer of Warranties and Limitation of Liability
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Lumberjack Health disclaims all warranties, express or implied.
In no event shall Lumberjack Health, its directors, employees, or partners be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services.
11. Indemnification
You agree to indemnify and hold harmless Lumberjack Health and its affiliates, directors, employees, and partners from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
